Welcome to WomTra! WomTra is an online e-commerce marketplace platform that connects buyers with women entrepreneurs and sellers. By accessing, browsing, creating an account, or using the WomTra website or mobile application, you agree to be bound by these Terms & Conditions (“Terms”).
1. Definitions & Role Clarification
WomTra (“We” / “Us” / “Platform”): Refers to WomTra, operating as an online e-commerce marketplace platform and intermediary facilitating transactions between buyers and sellers.
Seller: Any woman entrepreneur, woman-led business, or women-owned enterprise listing and selling products through the WomTra platform.
User / Buyer (“Customer”): Any individual who visits, browses, or purchases products on the WomTra app or website.
2. Account Registration & Eligibility
User Account: Users may create an account using a mobile number, OTP, or other provided authentication channels. Users must comply with applicable laws and platform policies while using WomTra.
Seller Account: Sellers must provide accurate personal, business, banking, and operational information during onboarding. WomTra reserves the right to request verification documents for tax compliance (GST/TCS/TDS) and legal verification.
Account Approval: WomTra reserves sole discretion over seller account activation upon successful completion of identity verification and compliance checks.
3. Seller Verification & Identity Verification
Empowerment Focus:WomTra’s business model is specifically designed to onboard and empower women entrepreneurs and women-led enterprises.
Accuracy of Data: All information submitted by sellers must be genuine, accurate, and up to date. Providing false documentation, misleading details, or fraudulent verification attempts is strictly prohibited.
Information Usage: Seller information will be processed in accordance with the WomTra Privacy Policy for operational and compliance purposes. WomTra reserves the right to request periodic re-verification.
4. Product Listing & Intellectual Property (IP) Protection
Permitted Products: Sellers may only list authentic, legal, and permitted physical products (e.g., apparel, textiles, jewelry, handcrafted crafts).
Prohibited Goods: Counterfeit, copied, stolen, hazardous, illegal, or unauthorized brand replicas are strictly forbidden.
Listing Accuracy: Product descriptions, specifications, images, pricing, variants, and stock availability must be 100% accurate. False claims or hidden fees are not permitted.
Intellectual Property Guarantee: Sellers warrant that they hold full ownership or authorized licenses for all product images, brand names, and design patterns uploaded. Listing copyrighted designs or trademarked assets without authorization will result in immediate listing removal and potential account suspension.
Compliance Responsibility: The seller holds primary responsibility for product quality, safety standards, packaging compliance, and regulatory adherence.
5. Pricing, Payments & Settlements
Customer Payments:Buyers may complete transactions through WomTra’s authorized third-party payment processing partners.
Platform Deductions: WomTra reserves the right to deduct agreed platform commissions, shipping/logistics charges, payment gateway fees, and applicable government taxes (GST/TCS/TDS) prior to disbursing seller payouts.
Payout Schedule:Seller earnings will be settled into their verified bank account according to WomTra’s standard payout schedule.
Fault-Based Adjustments:In cases where returns or cancellations occur due to seller error (e.g., defective items, incorrect sizes/variants, or fake products), return logistics charges may be debited from the seller’s upcoming payout balance.
Tax Obligations: Sellers remain independently responsible for their own business tax filings and legal obligations.
6. Order Fulfillment & Logistics
Dispatch Timelines: Upon receiving an order, the seller must securely package and prepare the item for pickup within the designated processing timeline (SLA).
Packaging Quality: Sellers must use secure, durable packaging materials to minimize the risk of damage during transit.
Logistics Handling:Shipping and order tracking will be executed via WomTra’s integrated courier and fulfillment partners.
7. Returns, Replacements & Refunds
Eligibility: Returns, replacements, and refunds are governed by the specific return window and terms indicated on the product detail page.
Eligible Scenarios: Customers may initiate return requests for damaged goods, defective items, wrong shipments, or missing products within the allowable verification period.
Refund Disbursement:Approved refunds will be credited back to the customer’s original payment method upon internal verification and item inspection.
Policy Discretion:Approval of return and refund requests remains subject to WomTra’s internal verification guidelines.
8. Code of Conduct
Platform Integrity: All sellers and buyers must maintain professional, respectful, and lawful interactions across the platform.
No Direct Off-Platform Transactions: Attempting to bypass WomTra platform fees or negotiate direct transactions off the platform is strictly prohibited and will result in permanent account termination.
9. Account Suspension & Termination
WomTra reserves the right to temporarily suspend or permanently terminate any User or Seller account without prior notice under the following circumstances:
- Listing or selling counterfeit, illegal, or stolen products.
- Submitting false identity documents, fraudulent information, or misleading verification data.
- Infringing upon third-party intellectual property, copyrights, or trademarks.
- Engaging in direct off-platform transaction solicitations.
- Engaging in abusive, unprofessional, or illegal behavior toward support personnel, buyers, or logistics agents.
10. Intermediary Status & Limitation of Liability
Intermediary Status: In accordance with Section 79 of the Information Technology Act, 2000, WomTra operates solely as a marketplace intermediary connecting buyers and sellers.
Product Liability: Sellers are independently liable for the physical quality, safety, legality, and merchantability of their products.
Operational Commitment: WomTra employs industry-standard measures to maintain platform uptime, security, and marketplace integrity.
11. Amendments to Terms
WomTra reserves the right to modify or update these Terms at any time to reflect operational, legal, or policy changes. Revised Terms become effective immediately upon being published on the platform. Continued use of the platform constitutes acceptance of the updated Terms.
12. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of or in connection with WomTra shall be subject to the exclusive jurisdiction of the courts located in [Insert Your City Name, e.g., New Delhi / Mumbai / Noida].
